Job Description

The Capital Markets Authority (CMA) is inviting applications from accomplished legal professionals for the position of Assistant Director, Enforcement (Grade 4). Reporting directly to the Deputy Director, Investigations and Enforcement, the successful candidate will play a strategic role in directing enforcement initiatives that uphold market integrity while ensuring that regulatory obligations are consistently observed across licensed entities and market participants. The successful professional will oversee the planning, coordination, and continuous improvement of enforcement programmes that support the Authority's mandate of maintaining transparent, efficient, and accountable financial markets. The role requires a forward-thinking leader capable of managing complex regulatory matters, supervising enforcement processes, guiding multidisciplinary teams, and collaborating with internal departments as well as external investigative and prosecutorial agencies. Key Responsibilities

  • Provide strategic leadership in planning, coordinating, and evaluating enforcement programmes aligned with the Authority's regulatory objectives.
  • Lead the formulation, review, and implementation of enforcement policies, operational frameworks, procedural manuals, and performance improvement initiatives.
  • Direct enforcement activities designed to protect investors, strengthen market integrity, and discourage regulatory misconduct.
  • Coordinate administrative enforcement proceedings while ensuring full compliance with statutory, procedural, and legal requirements.
  • Review enforcement recommendations submitted by supervisory, financial analysis, approvals, and sustainability functions before recommending appropriate regulatory action.
  • Guide investigations involving breaches of securities legislation and ensure timely progression of enforcement cases.
  • Collaborate closely with legal teams in preparing enforcement documentation, pleadings, witness statements, and litigation support materials.
  • Coordinate engagement with criminal investigation agencies concerning offences affecting capital markets operations.
  • Support collaborative initiatives involving fraud investigations, financial crime detection, and recovery of unlawfully acquired assets.
  • Develop effective working relationships with prosecutorial agencies, government departments, and judicial institutions to facilitate successful legal outcomes.
  • Build partnerships with domestic and international regulatory organizations to improve enforcement effectiveness and information sharing.
  • Supervise the preparation of comprehensive enforcement reports, legal opinions, and management briefs.
  • Monitor compliance with enforcement procedures while recommending continuous operational improvements.
  • Ensure accurate maintenance of enforcement records, case management systems, and regulatory databases.
  • Provide technical guidance and mentorship to officers within the Enforcement Division.
  • Participate in policy reviews aimed at strengthening regulatory governance and investor protection.
  • Analyze emerging regulatory risks and recommend proactive enforcement interventions.
  • Promote ethical leadership, accountability, professionalism, and compliance across all enforcement operations.
  • Coordinate stakeholder engagements relating to enforcement awareness, regulatory obligations, and compliance expectations.
  • Perform additional leadership responsibilities assigned in support of the Authority's strategic enforcement mandate.

Qualifications & Requirements

  • Master of Laws (LLM), Master of Business Administration, Master of Public Administration, or an equivalent postgraduate qualification from a recognized institution.
  • Bachelor of Laws (LL.B) degree from a recognized and accredited university.
  • Admission as an Advocate of the High Court of Kenya.
  • Valid Advocates Practising Certificate.
  • Membership in good standing with the Law Society of Kenya.
  • Leadership course lasting a minimum of four weeks from a recognized institution.
  • Demonstrated proficiency in computer applications relevant to legal and regulatory practice.
